Protecting your personal data is particularly important to us. We process your data exclusively on the basis of the General Data Protection Regulation (GDPR), the Austrian Data Protection Act (DSG) and the Telecommunications Act 2021 (TKG 2021). Here we inform you about which data we process on this website.

When you visit this website, our web hosting provider automatically processes technical data transmitted by your browser: IP address, date and time of access, page visited, browser type and operating system, and the previously visited page. This data is needed to deliver the website and ensure its security. The legal basis is our legitimate interest in operating the website securely (Art. 6(1)(f) GDPR). The log files are deleted after a short time and are not combined with other data. We have a data processing agreement with our hosting provider (Art. 28 GDPR). Our web hosting and email provider is Xpirio.
If you contact us via the enquiry form, by email or by phone, we process your details (e.g. name, contact details, travel dates, number of guests and your message) in order to answer your enquiry and prepare an offer for you. The legal basis is the performance of pre-contractual measures at your request (Art. 6(1)(b) GDPR). Mandatory fields are marked; without this information we cannot process your enquiry.
The form data is sent to us by email. For this we use our email provider as a processor. If no booking is made, we delete your enquiry no later than six months after the last correspondence. If a booking is made, we keep the booking-related data for as long as statutory retention obligations require (in particular seven years under the Federal Fiscal Code, § 132 BAO). We keep your name, address and stay details (dates, apartment, number of guests) beyond that period so that we can recognise you as a returning guest and honour loyal guests (legitimate interest, Art. 6(1)(f) GDPR). You can object to this at any time, e.g. by e-mail to amrusch@happynet.at.
When you book, we process your details to perform the contract (Art. 6(1)(b) GDPR) and keep them for the periods required by tax law. A few days after your stay we ask you once by e-mail for a review (legitimate interest, Art. 6(1)(f) GDPR, Section 174(4) Austrian Telecommunications Act 2021). We only send offers, for example when next year opens for booking, with your consent (Art. 6(1)(a) GDPR). Every such e-mail contains an unsubscribe link; you can also object at any time by writing to amrusch@happynet.at.
Before arrival you can enter the details for the registration form online; on arrival you can also provide them on paper. We collect your name, date of birth, sex, nationality, address, travel document details for non-Austrian guests, and the names and dates of birth of those travelling with you, because we are legally required to do so (Sections 5 and 10 of the Austrian Registration Act, Carinthian Visitor Tax Act; Art. 6(1)(c) GDPR). The data is passed on to the municipality of St. Jakob im Rosental, also for the Carinthia guest card, and deleted after 7 years. Consent to offers by e-mail is voluntary and not required for check-in.
Via our interface for AI assistants (Model Context Protocol) you can check free dates and prices and send a non-binding enquiry. Your AI provider (e.g. OpenAI or Anthropic) processes your input under its own privacy policy; we only receive the details your assistant transmits for the enquiry (name, email address, travel dates, guests, message). We only process the enquiry once you click the link in our confirmation email (Art. 6(1)(b) GDPR). Unconfirmed enquiries are deleted after 14 days at the latest.
You can also write to us via WhatsApp. The button on our website is a simple link; WhatsApp only opens when you click it. WhatsApp Ireland Limited (Merrion Road, Dublin 4, Ireland) is responsible for transmitting the messages; data may also be transferred to Meta Platforms Inc. in the USA. We only use your message and phone number to answer your enquiry (Art. 6(1)(b) GDPR). If you do not want to use WhatsApp, you can reach us by email or phone. Information on data protection at WhatsApp: whatsapp.com/legal/privacy-policy-eea.
To protect the enquiry and booking forms against automated submissions, your browser solves a small computing task in the background while you fill in the form (proof of work based on the ALTCHA principle). This takes place solely between your browser and our server: no data is passed on to third parties and no cookies are set. So that a solution cannot be used twice, we store it without any link to your person for a maximum of 20 minutes (legitimate interest, Art. 6(1)(f) GDPR).
This website does not set any cookies and does not use any third-party web analytics or marketing services. To understand how our pages are used, we count visits ourselves: we only store aggregated daily figures (page viewed, language, the domain of the previous website, device type and the steps of the booking process) – no IP addresses, no cookies and nothing that could identify you. To count visitors per day, a checksum is created from the IP address and browser identifier using a random key that changes daily, and it is deleted at the end of the day (legitimate interest, Art. 6(1)(f) GDPR). The fonts are stored locally on our server; no connection to Google or other providers is made when you visit the page.
Our website contains links, for example to Google Maps for route planning or to bergfex for hiking trails. Only when you click such a link are you forwarded to the website of the respective provider. Their privacy policy applies there.
This website is transmitted via an encrypted connection (HTTPS). This means third parties cannot read the data you enter in the enquiry form.
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21). Simply contact us at amrusch@happynet.at.
If you believe that the processing of your data violates data protection law, you can lodge a complaint with the supervisory authority. In Austria, this is the Austrian Data Protection Authority (Datenschutzbehörde), Barichgasse 40–42, 1030 Vienna, dsb@dsb.gv.at, www.dsb.gv.at.
